MAILOGA REPAIR AND TECHNICAL SERVICE TERMS
Version 2026-10-31.1. Read these terms together with the accepted estimate, specific authorisations and case records. A request or acknowledgement is not an accepted estimate, a payment or confirmation that a repair is complete.
1. Parties and authority
Provider: MAILOGA TRADE, S.L.U., Spanish tax ID B70532080, Avenida dos Bosques 18, local 2, 15142 Arteixo (A Coruña), Spain. Telephone 881 963 297; contractual and privacy contact info@mailoga.com or the contact form at mailoga.com. The case identifies the customer and any representative. Proportionate evidence of authority may be requested; identity-document copies are not collected by default. Customers must be authorised to hand over the device and instruct the work. MAILOGA must still investigate relevant inconsistencies.
2. Agreement and records
The agreement comprises the version of these terms presented, the accepted itemised estimate, intake inventory, specific authorisations and agreed amendments. Individually agreed terms prevail where lawful. Documents can be reviewed, corrected and downloaded before deciding. Acceptance relates to the exact version; silence or an automatic notice does not authorise additional work or charges. Manual validation only opens case handling. Accepting a priced estimate creates the agreed payment obligation but does not itself debit a card or initiate payment.
3. Scope and estimates
The estimate identifies the equipment, symptoms, diagnosis, objectives, work, parts, software, checks, specific exclusions, anticipated delivery and responsible person. Feasibility is assessed before a result is promised. Complete data recovery, universal compatibility, elimination of every vulnerability or a specified remaining device life are not guaranteed unless expressly agreed, without excluding duties of professional care or statutory conformity. Additional faults or scope changes must be notified and accepted in a separate estimate before the work. Where Spanish Royal Decree 58/1988 applies, written estimates are valid for at least 30 days from communication and must be available within the applicable statutory period, no more than five working days under that regime. Paid diagnosis must be priced and authorised in advance. Lawful limits on charging for an unaccepted estimate apply; declining does not trigger a default penalty.
4. Intake and custody
A deposit receipt records the customer, brand, model, available serial number, accessories, apparent condition, date, purpose and applicable anticipated dates. Photographs support the inventory. Discrepancies are recorded. Customers should disclose known faults, liquid exposure, prior work, locks and relevant risks, and supply only necessary accessories. Do not send passwords, recovery codes or unrelated personal documents through case messages. MAILOGA must safeguard equipment while in its custody and record handovers; missing insurance does not transfer all loss or theft liability to the customer.
5. Prices, payment and invoices
Euro estimates itemise net amounts, tax and total, including any agreed carriage, packaging, parts, licences and external services. Payment terms, advances and due dates must be stated beforehand and cannot be added unilaterally. Invoices must correspond to authorised work actually provided. Case status, an uploaded payment document or an email alone does not prove that funds have cleared. No fixed diagnosis, storage or cancellation charge is implied by this request.
6. Parts and licences
Parts must be suitable. Used, recovered, non-original or other alternatives requiring consent must be identified and expressly authorised, without being represented as new or original. Replaced parts are offered and returned where legally required; any lawful recycling instruction is recorded. A general recycling instruction does not authorise destruction of data media. Software must have a licence compatible with the work and use. The customer is responsible for rights to licences supplied by them, and MAILOGA for those it supplies as agreed. Licence protections and unauthorised accounts must not be bypassed.
7. Remote access and data operations
Remote sessions require the holder's authorisation and are limited to necessary tasks, permissions and time. Persistent, unattended or elevated access needs specific consent. Connections and temporary access are removed as agreed when the session ends. The customer may ask to stop a session; completed work and the device state are recorded. Before work, agree whether a verified backup exists, who creates it, its scope, location and cost. A backup recommendation does not exclude MAILOGA's liability for breach or negligence. Formatting, reinstalling, erasing, replacing storage, changing encryption or risky recovery requires a separate explanation and approval identifying the affected data/media, risks and intended outcome. Delivery of a device does not imply this consent. Only necessary content may be accessed, and technical copies must be returned or deleted within the agreed lawful period.
8. Confidentiality and processing on behalf of organisations
Staff access is limited and subject to confidentiality. If the customer controls third-party personal data and the work entails processing on its behalf, a data-processing annex must be completed before access. It defines purpose, duration, instructions, data and data subjects, security, subprocessors, assistance and return or deletion. No unrelated use, unauthorised subprocessors or unapproved international transfers are permitted. Security incidents must be reported to the controller without undue delay, preserving each party's applicable legal obligations.
9. Collection, shipping and return
Each shipment is agreed in advance: origin, destination, carrier, who arranges transport, packaging, packages, accessories, declared value, tracking, costs and conditions. Declared value is not proof of insurance or a guaranteed compensation amount. MAILOGA has declared no specific policy for customer equipment in the workshop or in transit; additional cover is included only if actually evidenced and expressly agreed, with scope, exclusions and cost. Lack of insurance does not remove mandatory liability of MAILOGA or the carrier for loss, theft, damage or breach. Applicable transport and consumer rules govern risks and liability; risk is not automatically passed to the consumer where prohibited. Packaging, visible damage, carrier reservations and applicable claim deadlines are documented without a blanket waiver.
10. Delays, handover and storage
Material delays are explained, with options where appropriate. Parts shortages do not authorise charges for unperformed work or remove mandatory rights. At handover the customer receives a work/parts/check summary, known limitations, recommendations, applicable invoice and warranty details. A staff handover entry, delivery evidence and a customer's own acknowledgement are distinct facts. Physical receipt does not waive hidden defects or warranties. Third-party collection requires proportionate authorisation and identification. Storage charges require prior lawful disclosure and agreement where required; under Royal Decree 58/1988 they do not start before the applicable one-month period following availability notification. Equipment is not automatically treated as abandoned, sold or destroyed because it has not been collected.
11. Warranties
Repairs governed by Royal Decree 58/1988 carry at least a three-month warranty from delivery, without reducing longer agreed periods or other statutory rights. Covered repeat faults or defects caused by the repair include the costs required by law. MAILOGA must substantiate any unrelated cause relied upon and cannot reject claims automatically. Goods, new parts and digital services/content may have their own statutory regime. Each work item or part may have a different period recorded in the delivery document; statutory suspensions and extensions must be recorded. A closed case or displayed end date does not prevent a claim where a right remains.
12. Withdrawal and cancellation
For distance service contracts, consumers generally have 14 calendar days from conclusion to withdraw, subject to applicable exceptions or special statutory periods. They may communicate an unambiguous withdrawal through the case, contact form or email; a template is provided. Starting within the withdrawal period requires a separate express request. If withdrawal follows such a start, only a legally payable proportionate amount may be charged. Loss of withdrawal rights following full performance of a paid service requires prior express consent and acknowledgement; accepting the estimate or partial performance alone does not remove the right. Requested urgent visits and supplied goods or licences have their applicable regime, explained before contracting. Other cancellations are settled against authorised work actually performed and admissible evidenced costs, without blanket penalties.
13. Complaints and responsibility
Customers can report an incident, warranty issue or complaint with evidence. Receipt and a reasoned response must be provided within applicable deadlines. This portal does not replace official complaint forms, consumer authorities, available alternative dispute resolution or competent courts. No membership of consumer arbitration is claimed without evidence. Mandatory consumer jurisdiction and international rules are preserved. Each party is responsible for attributable breaches under law. Liability for fraud, negligence, injury or other non-excludable rights is not waived; no universal cap equal to the repair price is imposed. Pre-existing damage, third-party actions or customer instructions are assessed on evidence and causation, while MAILOGA retains its professional duties.
14. Private portal, meetings and evidence
Access is for the account holder and authorised staff. Do not share credentials. Document versions, messages, decisions and necessary traceability are retained. Acceptances are linked to the precise document and a temporary code sent to the account email; account identity, declared name, time, IP and content fingerprint are recorded. These records may be submitted as evidence but their weight is for the competent authority to assess. This is not a qualified electronic signature or qualified timestamp service. Email verification is not documentary identity verification. An email notice does not guarantee delivery or reading. Meeting links open the named provider; meetings are not recorded by default and recording needs specific information and a lawful basis.
15. Case privacy and retention
MAILOGA controls data needed for requests, contracts, support, logistics, invoicing and claims. Legal bases are precontractual measures/contract, legal obligations and proportionate legitimate interests in security and claims. Marketing is not a service condition. Necessary hosting, mail, carrier and communications providers operate under applicable safeguards; relevant participants are identified in the particular arrangements. Avoid sensitive or unnecessary attachments. Records are retained during the relationship, warranties and applicable obligations/claims, with review on closure; six years is an operational reference for commercial records where applicable, not permission to retain unnecessary technical copies. A live claim can justify limited additional retention. Contact MAILOGA to exercise access, correction, erasure, objection, restriction or portability rights and the Spanish AEPD to complain. Erasure is balanced with legal obligations and claims. The general privacy policy provides further detail.
16. Withdrawal template
To MAILOGA TRADE, S.L.U., at the address/contact above: I withdraw from the service contract identified by case/estimate __________, concluded on __________. Consumer name __________, address __________, date __________. Signature only for a paper submission. Use of this template and reasons for withdrawal are not required.
